PRIVACY NOTICE TO VIRTUE TRUSTEE BERHAD (“VTB”)’S CLIENTS ON PERSONAL DATA PROTECTION ACT 2010

VIRTUE TRUSTEE BERHAD (“VTB”) or the (“Company”) is very committed to protect the security and confidentiality of your personal data. The Company ensures that your personal data will be processed in accordance with the provisions set out in the Personal Data Protection Act 2010 and/or other related legislation. This notice will explain to you how your personal data is collected, the purpose of such collection, and the use and disclosure of your personal data. Please note that your personal data may include your name, address, NRIC or passport number; telephone number, email address and/or bank account details. (collectively “Personal Data”).

1. Collection of Personal Data

We may collect personal data from you in the course of providing trustee services, including but not limited to:

a) Identification details (such as name, NRIC/Passport No., date of birth, nationality);
b) Contact information (such as residential address, email, telephone number);
c) Financial information (such as bank account details, tax information, source of funds);
d) Employment or business information;
e) Any other relevant information relevant to the services provided by the Company.

The Personal Data, whether stored in electronic or physical form, will be used, processed, and disclosed by the Company, its employees, sales representatives, affiliates, vendors and any other relevant third parties to facilitate the Company’s and administration.

2. Purpose of Collection

The Company shall not collect, use and process your Personal Data other than the following purposes:

a) to better understand your financial circumstances in order for the Company to provide quotes subsequently for you to enter into and execute the trust product;
b) for risk assessment, handling of payment of investment returns and net yield and audit purposes;
c) to manage and service the Company’s relationship with you and provide you with better customer service;
d) for marketing purposes where you have the right to write to request the Company to cease processing your Personal Data for marketing;
e) for data transfer, and sharing with, the Company and its Group and/or third parties acting on behalf of the Company, including those located outside Malaysia.

3. Disclosure of Personal Data

The Company may share your Personal Data with its employees, representatives, affiliates, commercial partners of the Company, regulatory authorities and other parties as required or permitted by law or as we may determine to be necessary or appropriate.

4. Access, Correction, and Withdrawal of Personal Data

As our client, you may submit a written request to access or correct your Personal Data held by the Company. Where required or permitted by law, such access or correction may also extend to personal data maintained by regulatory authorities or third parties.

You also have the right to withdraw your consent to the collection, use, or disclosure of your Personal Data at any time, subject to legal or contractual restrictions and with reasonable notice. Please note that withdrawal of consent may affect the Company’s ability to provide you with certain products and/or services, and we will inform you of the likely consequences before processing your request.

The Company will take reasonable steps to verify your identity and respond to your request within a reasonable timeframe.

5. Information About Another Person

You confirm that when you give the Company information about another person, you have been appointed to act for them and they have given their consent to the processing of their personal data.

6. Retention of Personal Data

Your personal data will be retained for as long as necessary to fulfil the purpose for which it was collected, or as required under applicable laws. Upon expiry of the retention period, the data will be securely disposed of or anonymised.

7. Consent

This Notice has been fully read and understood. Explicit consent is voluntarily provided, in accordance with the Personal Data Protection Act 2010, for the Company to collect, use, disclose, transfer, share, or otherwise process the Personal Data, including any Sensitive Personal Data (if applicable), of the undersigned and/or other persons on whose behalf this consent is given, for the purposes stated above.

VTB will take reasonable and best efforts to safeguard your personal data within its possession and control by implementing reasonable security measures to mitigate the risks of unauthorised access, collection, use, disclosure, copying, modification, disposal or similar threats. Despite these measures, VTB does not guarantee the absolute security of any personal data that may have collected from or about you. VTB holds no liability for any damages resulting from any personal data breaches, on unauthorised and/or fraudulent use of your personal data.
